Spain (August 16, 2021). From 1 July 2021, a new regulation entered into force in Spain. This law limits the possibilities of intervention along the road in the event of a breakdown: as a rule, no intervention takes place on the side of the road itself.
The Royal Decree 159/2021 establishing new conditions for roadside interventions in the event of a breakdown applies to all vehicles driving in Spain and applies to Spanish and non-Spanish carriers. Exceptions:
– if the operation takes less time than removing the vehicle from the road;
– if the action is necessary to remove the immobilized vehicle.
In both cases, the necessary measures must be taken to guarantee maximum safety and visibility. In this sense, it is prohibited to perform any action on the side immediately adjacent to the traffic flow. If there is no alternative, the authorities must be warned before the operation and they will determine the measures that will allow them to act in complete safety.
